Terms & Conditions
for the Online Sales of Goods and Services
These Terms and Conditions (“Terms”) govern your purchase and use of digital products (Squarespace templates, downloads, tutorials) and services (template transfers, customization, restyles, or similar) offered by Kickstart Creatives (“Kickstart Creatives,” “we,” “us,” or “our”) via kickstartcreatives.com (the “Site”).
By purchasing from the Site, you agree to these Terms. If you don’t agree, please do not purchase or use our products or services.
⚠️ Heads up: These Terms include a binding arbitration clause. Disputes are resolved by arbitration instead of in court or by jury trial.
1. Eligibility
You must be 18 years or older (or the age of majority in your jurisdiction) to purchase.
2. Pricing & Customer Responsibilities
All prices are listed in U.S. Dollars (USD) and may change without notice.
You are responsible for all costs tied to your Squarespace account, including (but not limited to): domains, hosting, monthly/annual plans, email accounts, and third-party add-ons.
Taxes, if applicable, are added at checkout.
We reserve the right to correct pricing or typographical errors.
3. Orders & Payment
Your order is an offer to purchase under these Terms. We may accept or decline at our discretion.
Payment must be received before delivery of digital products or the start of any service.
You confirm that:
your payment info is accurate,
you’re authorized to use it,
your payment provider will honor charges.
Chargebacks or disputes may result in suspension or revocation of your license and access.
4. Delivery & Timelines
Digital products are delivered electronically (no physical shipping).
Services are scheduled/fulfilled within timelines stated on the sales page or your order confirmation. Timelines may shift if we’re waiting on your content, access, or approvals.
5. License (Single-Use)
Each template or digital file comes with a single-use, non-transferable license for one (1) website (personal or commercial).
You may not:
resell, redistribute, sublicense, or share the files;
claim the design or materials as your own;
use the same template on a second site without buying another license.
Agencies/Designers: One license = one client project. Each new client/site requires a new license.
6. Copyright & Showcase
All templates, assets, and materials remain the intellectual property of Kickstart Creatives.
You may not share design files or included materials outside your licensed site.
We may showcase your completed site in our portfolio, template gallery, sales pages, or social media.
Want to opt out? Email hello@kickstartcreatives.com and we’ll remove/avoid featuring you.
7. Demo Content, Fonts & AI Images
Templates ship with demo copy, images, and graphics as placeholders.
Demo visuals may be created in-house (including with AI tools) or sourced from free-stock libraries.
We cannot guarantee perpetual rights or suitability for your business.
To avoid licensing concerns, you should replace all demo images with your own assets.
Fonts used are native to Squarespace (or platform-hosted). Custom/third-party fonts are your responsibility to license properly.
8. Requirements, Scope & Support
To use our templates, you need:
an active Squarespace account
a Business Plan (or higher)
Included with purchase:
The template design (delivered as a new site or, if you add installation, applied to your existing Squarespace 7.1 site).
3 months of support for template-related questions (Squarespace, template, or basic Canva/Photoshop).
Not included (unless expressly purchased):
Site migration from other platforms (WordPress, Wix, Showit, etc.)
Customizations or revisions beyond the purchased scope
Uploading/formatting your content
Domain or email setup
SEO setup or analytics
Social media connections
Third-party integrations
IT or computer troubleshooting
Coding beyond what’s built into the template
➡️ Templates are intended for DIY customization. You’ll need basic comfort with a computer, Squarespace, and the internet. If you prefer a hands-off option, check out our Template Transfer or Customization packages.
9. CSS Note
Your template may include small CSS snippets to achieve the demo look.
Editing CSS is optional; any edits are at your own risk.
10. Refunds & Cancellations
Digital products (templates, downloads, courses, tutorials) are non-refundable and non-returnable. Please review the demo carefully before buying.
Services are refundable only at our discretion, depending on work already completed. Any refund granted excludes work performed and non-recoverable fees.
We do not guarantee business outcomes or results.
11. Warranty Disclaimer & Limitation of Liability
Products and services are provided “as is” and “as available.”
We disclaim all warranties (express or implied), including merchantability and fitness for a particular purpose.
We are not liable for lost profits, revenue, data, business opportunities, or any indirect, incidental, special, consequential, or punitive damages.
Our total liability will not exceed the amount you paid for the specific product or service.
12. Template Transfer Add-On — Terms & Conditions
1. Service
Must be purchased with a Kickstart Creatives template for installation on your Squarespace 7.1 site.
You’ll grant us Contributor/Admin access. We manually recreate the demo design on your site.
You are responsible for replacing demo placeholders with your own content.
Available only for templates created by Kickstart Creatives.
2. Timeline
Typically completed within 24 hours of accepting your Contributor invite.
If delays occur (e.g., access or platform issues), we’ll email a new timeframe.
3. Includes
Installing template pages/sections onto your Squarespace 7.1 site
Creating new pages (in “Not Linked”) as shown in the demo
4. Does Not Include
Customization of any sort
Revisions or refinements
Adding or formatting your content
Changes to existing pages (beyond applying global styles)
SEO setup or analytics
Squarespace tutorials or training
Social media connection
Migration of any kind (content, domains, etc.)
Domain connection
Third-party integrations
5. Errors & Content Changes
Backups: We recommend backing up your text/images; we cannot be responsible for accidental content loss.
Platform Errors: We aren’t liable for Squarespace outages, bugs, or data loss.
Global Style Effects: Installing a site-wide design means your existing content will likely look different (fonts, colors, spacing). This is expected.
6. Refunds
Installation is a service. Once we accept your Contributor/Admin invite, the purchase is non-refundable.
Before acceptance, you may request a refund in writing.
13. Intellectual Property Ownership
All templates, documentation, graphics, videos, and training materials are owned by Kickstart Creatives.
You receive only the license rights described above.
14. Privacy
We respect your privacy. See our Privacy Policy for how we collect and use information.
15. Changes to These Terms
We may update these Terms at any time.
The “Last Updated” date shows the latest version.
Continued use of our products/services means you accept the changes.
16. Governing Law & Arbitration
Governed by the laws of Alaska (without conflict-of-law principles).
Both parties agree to try informal resolution within 30 days before filing a claim.
If unresolved, disputes will be settled by binding arbitration in Alaska (or another mutually agreed location).
Arbitration awards may be entered in a court of competent jurisdiction.
17. Indemnification
You agree to indemnify and hold harmless Kickstart Creatives (owners, employees, contractors, affiliates) from any claims, losses, or expenses (including attorney fees) arising from your breach of these Terms or misuse of our products/services.
18. Miscellaneous
No Waiver: Failure to enforce a term doesn’t waive it.
Severability: If one part is unenforceable, the rest still applies.
Assignment: You may not assign your rights; we may assign ours.
Entire Agreement: These Terms are the entire agreement and supersede prior communications.
